The City Sidewalk Commission shall have the following powers and duties pursuant to this chapter:
(a) To initiate and promulgate planning specifications, rules and regulations for the construction, reconstruction, modification and repair of any and all sidewalks within the City.
(b) To make recommendations to the various departments of the City and to Council as to the location, type, planning, engineering specifications, cost and other aspects associated with the construction, reconstruction, modification and repair of sidewalks within the City.
(c) To develop an official master sidewalk plan for the City to be followed in carrying out the provisions of this chapter.
(d) To conduct investigations of the necessity for and the practicality of sidewalks within various areas of the City.
(e) To assist the Service Director, Zoning Inspector, the Planning and Zoning Commission and any and all other City officials in implementing the master sidewalk plan to be created by this Commission and in otherwise carrying out the rules and recommendations of this Commission.
(f) To review proposed amendments to the master sidewalk plan and make recommendations to Council regarding the same.
(g) To hear and decide appeals where it is alleged there is an error in any order, requirement, decision or determination made by the Service Director relating to the master sidewalk plan or the planning specifications, rules or regulations of this Commission.
(h) To authorize variances from the planning specifications, rules and regulations established by this Commission where such variances shall not be contrary to the public interest or where, owing to special conditions of the land, a literal enforcement of this chapter would result in unnecessary hardship in accordance with the provisions of this chapter.
(i) To conduct all other actions or duties necessary for the establishment and creation of a master sidewalk plan and implementation of this plan by the creation of rules and regulations relating to the construction, reconstruction, modification and repair of sidewalks within the City with the purpose of promoting the health, safety and general welfare of the citizens of the City.
