377.03 OPERATOR PROHIBITIONS.
   (a)   No person operating a motorized bicycle shall:
      (1)   Carry another person upon the motorized bicycle;
      (2)   Fail to use safety glasses or other protective eye device;
      (3)   Ride other than upon the permanent and regular seat attached thereto, facing forward, with one leg on each side of the moped;
      (4)   Carry any package, bundle, or article that prevents the operator from keeping at least one hand upon the handle bars;
      (5)   Attach the moped to any streetcar, trackless trolley, or vehicle upon a roadway;
      (6)   Remove both feet from the pedals, practice or perform any acrobatic riding;
      (7)   Operate a moped upon a sidewalk within the business or residential areas of the Municipality;
      (8)   Park a moped on a street or sidewalk in such a manner so as to obstruct pedestrian or vehicular traffic.

   (b)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
