Any applicant for permission to open any street within the town must post with the Town Clerk a non-refundable fee, set by resolution, payable to the town for each opening of a paved street or alley, and a fee set by resolution for any unpaved street or alley. The non-refundable fee shall be for any liability of any kind or character whatsoever, which may arise as a result of the applicant’s opening any street, or which may, in any way or manner, be connected with or related to the excavation.
