§ 115.04 STANDARDS FOR ISSUANCE.
   (A)   The Clerk-Treasurer shall approve the application unless there is tangible evidence that the conduct of the applicant's business would pose a substantial threat to the public health, safety, morals, or general welfare. In particular, tangible evidence that the applicant has done any of the following will constitute a valid reason for disapproval of an application:
      (1)   Has been convicted of a crime of moral turpitude;
      (2)   Has made willful misstatements in the application;
      (3)   Has committed prior violations of ordinances pertaining to itinerant merchants, peddlers, solicitors, and the like;
      (4)   Has committed prior fraudulent acts;
      (5)   Has a record of continual breaches of solicited contracts; or
      (6)   Has an unsatisfactory moral character.
   (B)   In addition to the Clerk-Treasurer, applications may be reviewed by other town departments, including, but not limited to, Police, Fire, and Utilities and Zoning, for approval where applicable.
   (C)   Any application for any vendor to be located in any town park will be forwarded to the Park Director for review.
   (D)   Non-profit and not-for-profit organizations, including but not limited to, religious organizations, school-related organizations, girl and boy scouts, and other non-profit and not-for-profit organizations having a 501C-3 status, are required under this chapter to apply for a permit, but will not be subject to applicable fees.
