There are hereby established for the use of and the service rendered by the waterworks system of the town the following rates and charges based on the use of water supplied by the waterworks system:
(A) Metered Monthly Usage Charges.

(B) Minimum Monthly Charges. Each user shall pay a minimum monthly charge in accordance with the following applicable size of meter installed.

(C) (1) Fire Protection. The cost and value of maintaining fire hydrants and other facilities for fire protection shall be excluded from the charges against the municipality and shall be recovered from the other customers of the waterworks beginning no sooner than January 1, 2014.
(2) Hydrant Rental Fee.

(3) Cost and Value of Maintaining Fire Hydrants and Other Fire Protection Facilities.
(a) The cost and value of maintaining fire hydrants and other facilities for fire protection shall no longer be paid out of the town’s general fund, but shall be paid directly into the waterworks fund as a user fee and shall be formally adopted each year as a part of the water utility rate ordinance.
(b) All properly owners of real property located within the municipal boundaries of the town, and all property owners outside of the municipal boundaries served by the town water utility's hydrants, shall assume responsibility for paying the cost and value of maintaining the fire hydrants and other facilities for fire protection, and these costs shall be recovered from the customers and users of the waterworks beginning on January 1, 2014.
(c) The new schedule of rates shall:
1. Eliminate fire protection charges billed directly to the governmental unit, other than charges for the construction cost of new fire hydrants installed on and after the date specified in the ordinance; and
2. Increase the rates charged each customer of the utility, based on equivalent meter size, by an amount equal to:
a. The revenues lost from the elimination of such fire protection charges; divided by
b. The current number of the equivalent users and rate payers of the waterworks system.
(4) Late Fee. If the monthly fire hydrant fee is not paid by the due date stated on the bill, a late charge of 10% will be assessed, together with costs of collection, if any, including reasonable attorney’s fees.
(D) Automatic Sprinkler Charges. Each user shall pay an annual charge for each sprinkler connection in accordance with the following based upon the applicable size of sprinkler installed.

(E) The rates herein approved shall provide for a reasonable return on the water utility plant of the town and such other legal and other necessary expenses as provided for in I.C. 8-1.5-3-8.
(F) Bulk rates. The rate for water sold by the tank load in bulk form shall be $2 per 100 gallons. These rates are including sales tax.
