§ 34.09 ECONOMIC DEVELOPMENT COMMITTEE.
   (A)   There is hereby created the Cicero Economic Development Committee which shall serve in an advisory capacity to the Cicero government agencies, the various utilities, the business community, and the community at large in promoting and facilitating the prosperity, economic stability, and general welfare of the town.
   (B)   The Committee shall be under the control of the Town Council.
   (C)   The Cicero Economic Development Committee shall consist of seven members who shall be appointed as follows:
      (1)   The President of the Cicero Town Council shall appoint three members who shall serve two-year terms. One of the three members appointed herein by the President must be a resident who either resides within the corporate municipal boundaries of the Town of Cicero or within one mile of the Cicero municipal boundary, and one member appointed by the President of the Town Council must either be a business owner or a designated representative of a business which is located within the Town of Cicero, and the remaining member appointed by the President of the Town Council may either be a resident who resides within the corporate municipal boundaries of the town or within one mile of the Cicero corporate municipal boundaries and/or who must either be a business owner or a designated representative of a business which is located within the Town of Cicero.
      (2)   Four members shall be appointed by the Cicero Town Council of which two members must be residents of and reside within the corporate municipal boundaries of the Town of Cicero, and the third appointment of the Town Council must either own a business that is located within the Town of Cicero or be a designated representative of a business which is located within the Town of Cicero, and the fourth appointment by the Town Council may either be a resident of and reside within the corporate municipal boundaries of the Town of Cicero and/or must either own a business that is located within the Town of Cicero or be a designated representative of a business that is located within the Town of Cicero.
   (D)   The term of office for the members of the committee appointed by the President of the Town Council shall be for a two-year period, and the term of office for the members appointed by the Town Council shall be for a period of three years.
   (E)   The appointment of members by the Cicero Economic Development Committee shall be made by the respective appointing entity within 15 days after receiving notice from the Secretary of the Town Council that they are required to make such appointments. At the expiration of the respective initial terms of each of the members originally appointed, their respective successors shall be selected before the expiration of the term in the same manner as the original appointee, and each succeeding member shall serve a term of two years. In the event any person appointed as a member shall fail to accept the appointment hereunder, within ten days after the mailing of notice to him or her of his or her appointment, or if any member after being appointed shall die, resign, or vacate such office, a new member shall be selected and appointed to fill such vacancy in the same manner as the member in respect to whom such vacancy occurred, and the member so appointed shall serve the remainder of the vacated term. Members shall hold over after the expiration of their terms until their respective successors have been duly appointed and qualified. Such members shall receive no salaries or remuneration of any kind.
   (F)   The Committee shall elect one of its members as president, one as vice president, one as secretary, each of which officers shall serve from the day of his or her election until the first day of June next following his or her election and until his or her successor is elected and qualified. In addition, to the election of a president, a vice president, and a secretary, the Committee may also elect a recording secretary whose duties and responsibilities shall be to record the minutes of the meetings and to care for and maintain the various records and documents of the Committee.
   (G)   The Committee is authorized to adopt such by-laws, rules and regulations as it may deem necessary for the proper conduct of its proceedings and the carrying out of its duties. Said by-laws, rules and regulations shall be subject to review and approval by the Cicero Town Council. Regular or special meetings of the Committee shall be held at such time as it may determine and upon such notice as it may decide, either by resolution or in accordance with the provisions of the by-laws, rules and regulations adopted. A majority of the Committee shall constitute a quorum and the concurrence of the majority shall be necessary to authorize any action.
   (H)   As stated above, the said Committee shall serve in an advisory function and capacity to the Cicero Town Council, to the Cicero business community, to various other governmental and/or utility agencies, and to the community at large. The Committee shall, among other things, provide input to the various governmental bodies regarding existing and/or new ordinances that have a direct effect on the business community. It shall vigorously recruit business and industry, and it shall create awareness of the business opportunities and resources that are available to businesses in and around Cicero, Hamilton County, Indiana. In addition, the Committee will provide businesses with a central location to gather pertinent, up-to-date information on the local opportunities of doing business in Cicero, Indiana, including but not limited to licensing, permits and building services. In addition to foregoing, the Committee will undertake additional tasks as may be assigned from time to time by the Town Council.
   (I)   Since the Cicero Economic Development Committee will serve only in an advisory capacity, it does not have the legal authority nor the legal standing to incur debt, enter into contracts or agreements, or to undertake any actions of any kind that would be legally binding upon the Town of Cicero, the Cicero Town Council, or the residents of the town.
   (J)   A member of the Cicero Economic Development Committee may be dismissed, with or without cause, by the President of the Cicero Town Council in regard to the two members appointed by the Town Council President, and by the Cicero Town Council with respect to the three members appointed by it.
