§ 33.27 MEMBERSHIP REQUIREMENTS.
   (A)   Eligibility for membership.
      (1)   In no event shall a pension be paid to an employee of the Police Department who, at the time of appointment, was over 35 years of age or who failed to pass the medical examination required and provided by the Pension Board. The Pension Board shall have the power to require and provide for a medical examination for employees of the Police Department, and to accept or reject them as members of the Pension Fund. However, any person who is over the age of 35 years at the time of appointment, or who has failed to pass the required medical examination, shall be exempt from paying or contributing any money to the Fund. Further, every member of the Police Department who is in active service at the time the Fund is established shall, regardless of their age at the time they became members of the Department, become members of the Fund and shall pay the assessment herein provided, if they successfully pass the physical examination required by the Pension Board.
      (2)   Police officers who are in active service at the time of passage of this subchapter and who become members of the Pension Fund shall be entitled to have all their prior years of active service of such police officer on the town police force counted in determining eligibility for retirement, only if they pay the same amount into the Pension Fund as they would have paid as dues during all the years of service with the Police Department prior to the passage of this subchapter.

   (B)   Physical. It shall be the duty of the Police Surgeon to make all examinations of the members of the Police Department whenever requested by the Pension Board; whenever any member requests him to do so for the purpose of certifying his physical or mental condition to the Board; or whenever he deems it proper to do so; and the Police Surgeon shall thereupon certify to the Board the true physical or mental condition of the member.
