§ 31.35 ESTABLISHMENT OF OFFICE; POWERS AND DUTIES.
   (A)   There may be established the office of Building Commissioner. Any such Building Commissioner or Deputy Commissioner(s) as may from time to time be appointed or employed shall serve at the pleasure of the Town Council.
   (B)   The powers and duties of the Building Commissioner shall be those determined necessary and established by the Town Council, but shall include enforcement of all building code provisions, zoning codes, provisions of the master plan and ordinances of the town and any other territory within the jurisdiction of the Town Plan Commission.
   (C)   The Building Commissioner shall maintain records of all transactions involving permits, applications, inspections, fees and fines in a manner as may be prescribed by the Town Council and at all times consistent with guidelines acceptable to the State Board of Accounts or similar authority.
   (D)   The selection of the Building Commissioner shall be by appointment of the President of the Town Council and subject to majority approval of the Council members.
   (E)   The position of Building Commissioner may be full or part-time, and the duties may be performed by an employee of the Town as selected in subsection (D) or other qualified agency or entity, and compensated at an amount and paid in the manner determined by the Town Council.
   (F)   Any such Building Commissioner so appointed shall not engage in any business activity within the territory or jurisdiction of Town Plan Commission which may be determined a conflict of interest under any state or local law or ordinance, except upon express written approval of the Town Council and then only in such manner as may be otherwise lawful.
