§ 31.26 VIOLATIONS CLERK.
   (A)   Pursuant to I.C. 33-6-1(c), the Clerk-Treasurer of the Town of Cicero is hereby designated as the Violations Clerk for purposes of this chapter.
   (B)   Subject to the terms, conditions, and qualifications set forth in division (D) hereof, the following ordinances and the Cicero Code of Ordinances shall be subject to admission of violation before the Clerk-Treasurer of the Town of Cicero, or his/her designee:

   (C)   The penalty for the first violation of any ordinances or Code Chapter set forth herein and disposed of through the Violations Clerk shall be $25.00. The penalty for a second violation of the same ordinance within the same calendar year shall be $50.00. The penalty for a third or subsequent violation of the same ordinance within the same calendar year shall be $100.00.
   (D)   The penalties prescribed in division (C) of this section shall apply only when an alleged violator elects to admit an ordinance or code violation and pays the prescribed fine to the Violation Clerk. Division (C) of this section shall not amend or supersede any other penalty sections of the Cicero Code of Ordinances including, but not limited to, the abatement of nuisances, issuance and revocation of licenses, the right of the town to files liens against personal and real property, the destruction of the town’s property, the right of the Cicero Police Department to declare and dispose of abandoned and/junk vehicles, the enforcement of Title XV of the Code of Ordinances entitled Land Usages, and the right of the town, the Cicero Plan Commission, and/or the Cicero Board of Zoning Appeals to seek preliminary and/or injunctive relief in a court of law. In the event of a violation of the town’s Code of Ordinances including, but not limited to, weeds, nuisances, abandoned and/or junk vehicles, illegal sewer and water tap-ins, zoning, subdivision control, and land usage, the Department, Agency, Commission, Board, Council, or the person empowered by federal, state, and local statutes, ordinances, rules and regulations, in the application and enforcement of the said statutes, ordinances, rules and regulations shall, in its sole discretion, make a determination as to whether to apply and enforce the penalty prescribed in division (C) of this section or to proceed under any other penalty sections of the Cicero Code of Ordinances. If the enforcement entity makes a determination to proceed under any other penalty section of the Cicero Code of Ordinances, then the schedule of penalties set forth in division (C) hereof and the payment of the same to the Violations Clerk shall not apply.
   (E)   If an alleged violator who has been cited under this section elects not to admit an ordinance violation, the town shall have the right to bring suit against the alleged violator seeking fines greater than those permitted under division (C), which are otherwise authorized by the Cicero Code of Ordinances.
