§ 71.05 USE OF SKATEBOARDS.
   (A)   (1)   No person riding on or by means of a skateboard, coaster, scooter or similarly-wheeled toy vehicle or device shall park, stand or use the same upon the streets, roads, sidewalks, grassy areas, and public parking areas, public rights-of-way, and town parks located within the town;
      (2)   It is hereby declared a public nuisance, and therefore, a violation of this section to ride or operate a skateboard, coaster, scooter, toy vehicle or any similar wheeled toy vehicle or device on the streets, sidewalks, grassy areas, ramps, and public parking areas within the rights-of-way, roads, streets, and highways set forth hereinabove.
      (3)   Any skateboard, coaster, scooter or other similar toy vehicle or device operated in violation of this section may be temporarily held by the town to abate the nuisance.
      (4)   Any person, upon conviction for a first or second violation of this section, shall be liable for a fine of up to $100 for each such violation.
      (5)   Any person, upon conviction for a third or subsequent violation of this section, may be liable for a fine up to $500.
   (B)   An exception to this section exists for special events, parades, and similar activities where a right-of-way use or other applicable permit from the town is in effect for the activity.
