§ 51.40 ACCIDENTAL DISCHARGES.
   (A)   Each discharger shall provide protection from accidental discharge of prohibited or regulated materials or substances. Where necessary, procedures and facilities to prevent the accidental discharge of prohibited materials shall be provided and maintained at the discharger's expense. Detailed plans showing facilities and operating procedures to provide this protection shall be submitted to the town for review, and be approved by the Town Engineer before construction of the facility. Review and approval of plans and operating procedures by the town shall not relieve the discharger from the responsibility to modify its facility as necessary to meet applicable requirements.
   (B)   Dischargers shall orally notify the wastewater treatment plant immediately when a slug load, accidental discharge, any unusual flows or wastes or any wastewaters discharged in violation of this subchapter, accidentally or otherwise to the sewer system occurs, to enable the wastewater treatment plant to take countermeasures to minimize damage to the community sewer, treatment facility, treatment process and receiving waters. Dischargers shall notify the wastewater treatment plant at designated telephone number during all hours. The notification shall include location of the discharge, date and time of occurrence, type of waste, concentration and volume, and corrective actions which were taken.
   (C)   This notification shall be followed, within ten days of the date of the occurrence, by a detailed written statement describing the accidental discharge, the causes, duration including times and dates of noncompliance, and the measures being taken to prevent future occurrences.
   (D)   Such notification will not believe the users of a liability for any expense, loss or damage to the sewer system, treatment plant or treatment process, or for any fines imposed by the town by state or federal regulations, rules and statutes.
   (E)   In order that employees of users be informed of town requirements, users shall make available to their employees copies of this subchapter and together with such other wastewater information and notices which may be furnished by the town from time to time, directed toward more effective water pollution control. A notice shall be furnished and permanently posted on a user's bulletin board or other conspicuous place advising whom to call in case of accidental discharge in violation of the subchapter.
