18.28.080: APPEAL OF LAND USE AND DEVELOPMENT COMMISSION DECISION:
Written appeals of LUDC's decisions, not recommendations, may be filed by the applicant or any affected person having a bona fide interest in real property as defined in Idaho Code section 67-6521. The appeal petition must be submitted within ten (10) days of the Chair's approval of the written final decision, contain a description of the grievance as it pertains to the specific standards for approval. The appeal shall be heard within a reasonable time by the Council to review the decision of LUDC and to hear testimony of the appellant and applicant (if different from appellant). The Council shall determine whether to uphold, modify, or overturn the decision of the LUDC, including whether to remove or add conditions. (Ord. 832, 2021)
