15.04.010: BUILDING CODES ADOPTED:
The approved editions of the following nationally recognized codes, as adopted by the state of Idaho or the Idaho building code board ("board") are adopted as the official building codes of the city:
International building code, including all rules promulgated by the board to provide equivalency with the provisions of the Americans with disabilities act accessibility guidelines and the federal fair housing accessibility guidelines.
International energy conservation code.
International fire code and such appendices as have been or are from time to time adopted by the state of Idaho acting through the department of insurance. For purposes of section 101.1 insert "city of Chubbuck fire department" and for section 109.3, insert "misdemeanor - $300.00 - 60 days".
International residential code, parts I-IV and IX.
National electrical code, 2008 edition, and appendix H.
Uniform plumbing code, 2006 edition, and its appendices as follows:
Appendix A;
Appendix B;
Appendix D;
Appendix E;
Appendix L.
The adopted versions of these codes shall be deemed superseded by successive versions of such codes as they are adopted or approved by the board, effective on the date any such codes are made effective by the board.
Any provisions of any such code that conflict with the personnel procedures and the general employee policy of the city as it relates to the status of any employee and that employee's due process rights or with Idaho Code sections 50-204 through 50-206 regarding appointed officers of the city shall not be applicable; state law and the personnel policies of the city shall control those matters.
Appendices and supplemental material contained within the uniform plumbing code and the international plumbing code may be used as guidelines for plumbing installations. In the event that a situation is not specifically covered by any of the codes adopted herein, the building official is hereby authorized to utilize other nationally recognized safety codes and standards as guidelines in determining applicable regulations.
Fees charged under these above codes shall be based upon the charges now in effect, notwithstanding the repeal of the codes upon which the fees are based, until such time as a different fee schedule is adopted or is determined to be provided in the codes adopted. (Ord. 695, 2011: Ord. 569 §2, 2002)
