5.40.230: LICENSES; DENIAL, SUSPENSION OR REVOCATION GENERALLY:
The city council may deny, suspend or revoke a treatment clinic's license:
   A.   If the background or criminal history check of any staff member who has contact with the children, reveals any violations of this chapter or any of the disqualifications listed in this chapter.
   B.   If the building and fire code checks, zoning checks, or health standards checks reveal that any of the building, fire, safety, or zoning provisions, made applicable herein, have not been met.
   C.   For violations of any of the terms of this chapter, or for other cause, after a hearing, upon not less than twenty (20) days' written notice to the licensee, such notice to specify the grounds for the proposed revocation or suspension.
The chief of police or the chief's designee may suspend a license without prior notice for a period not exceeding twenty (20) days for any violation; provided, any suspended licensee shall be entitled to have the suspension reviewed by city council at its next regular council meeting held within the twenty (20) days, or, if said meeting is beyond the twenty (20) day period, at a special meeting called to review said suspension. If a quorum of the council is unavailable within said twenty (20) day period, it may be extended by an additional ten (10) days to allow a quorum of the council to be assembled; however the suspension shall remain in effect during that period.
