§ 150.03 EXCAVATIONS IN STREETS OR ALLEYS.
   (A)   Permit required. It shall be unlawful for any person, firm or corporation to tunnel under or to make any excavation in any street or alley in the city without first obtaining a permit therefor as is herein required.
   (B)   Application for permit. Applications for permits shall be made to the City Clerk, and shall describe the location of the intended excavation or tunnel, the size thereof, the purpose therefor, and the person, firm or corporation doing the actual excavating work and the name of the person, firm or corporation for whom or which the work is being done.
   (C)   Time limit. The application for permit under this section shall state the length of time it is estimated will elapse from the commencement of the work until the restoration of the surface of the street or alley and it shall be unlawful to extend said time without the approval of the City Council.
   (D)   Fees. A fee of $25 shall be paid for a permit to tunnel under or to make any excavation in any street in the city and a like amount shall be paid when a permit to tunnel under or to make any excavation in any alley which has a paved or brick surface. No fee shall be required for any other permit required by this section.
   (E)   Manner of excavation. The permittee shall use due care in doing any tunneling or excavating under the permits provided for in this section and shall notify city authorities if any utility line owned by the city or affecting the public welfare of the people of the city is or are to be affected and any damage to any such line shall be repaired immediately at the cost of the permittee under the supervision of city authorities and no unnecessary damage or injury shall be done to any tree or shrub or the roots thereof.
   (F)   Restoring surface. Any person, firm or corporation making any excavation or tunnel in or under any public street or alley in the city shall restore the surface thereof to its original condition. Refills shall be properly tamped down and any required bracing shall be used. If any applicant under this section shall not comply with the provisions of this division (F), the city shall give notice at least 12 hours before acting and shall then replace the street or alley to its former condition and the expense and cost thereof shall be charged to the applicant.
