It shall be the duty of the city health officer or the chief of police, when so requested by the city council, to notify any person or persons, corporation or corporations, or associations of individuals responsible for the commission or maintenance of a nuisance within the city limits or within three miles of the city limits to abate and remove such nuisance, and if such nuisance is not abated by the ones responsible therefor, then it shall become the duty of the city health officer or the.chief of police to forthwith file a complaint before the police magistrate setting forth the facts of the violation of this chapter or any other ordinance concerning nuisances, and an action shall forthwith be commenced to abate the same.
