5.24.070    Dispensary regulations.
Recreational use or adult-use marijuana dispensaries and medical marijuana dispensaries are permitted in the City and must conform to the following regulations:
   A.   Such dispensary businesses must be licensed and operated in full compliance with Montana law.
   B.   Such dispensary business must be operated from property zoned for commercial purposes.
   C.   No such dispensary business shall be operated from a building, structure, premises, or locale, or from any portion of a building, structure, premises, or locale situated on Indiana Street, commonly known as Main Street.
   D.   Such dispensaries may sell only pre-manufactured and pre-packaged products.
   E.   The owner and operator of the dispensary must acknowledge and grant authority for local law enforcement to inspect the premises of the dispensary at any time to ensure compliance with any public health, safety, and welfare requirements established by the Montana Department of Revenue, the Montana Department of Public Health and Human Services, and the regulations of the local government.
   F.   Such dispensaries must have sufficient security systems, including surveillance cameras, alarm systems, deadbolt locked exterior doors, and safes to store cash and protect retail marijuana products when closed.
   G.   All signage at such dispensaries must meet state licensing rules and requirements. (Ord. 533 §7, 2023)
