The city engineer, in his discretion, may grant or refuse to grant such application. The refusal to grant any such application is subject to review by the city council. When the application is granted, the applicant shall accomplish the proposed work within the time allowed by the city engineer and under his supervision; and, in accordance with rules, regulations and specifications prescribed by the city engineer, shall thoroughly backfill any such excavation or opening and restore the surface thereof to the condition it was in prior to such excavation or opening.
