Unless operating under a contract with the city which relates to openings in streets, alleys and other public ways, no person, persons, firm or corporation shall make any excavation in, cut through or tear open the surface of any street, avenue, alley, sidewalk or other public way within the city without first obtaining a permit therefor from the city engineer.
