If the holder of the title of the property in front of or along which such sidewalk or curb has been ordered constructed fails, neglects or refuses to construct such sidewalk or curb for a period of thirty days from and after the date of the first publication of such notice, if service thereof is made by publication, or for a period of thirty days from and after the date of mailing of such notice, if service of such notice is made by mail, the city council shall let a contract for the construction of such sidewalks and curbs and the costs of construction of the same may be paid by the city, and such costs of construction, together with all the expenses connected therewith, will be assessed against the premises in front of or along which the same has been ordered constructed and will become a lien against such property and may be enforced or the amount may be recovered against the owner of such property by a suit before any court of competent jurisdiction.
