A. Whenever any motor vehicle shall have been parked or left standing without a driver present in the vehicle, in violation of any of the provisions of city parking regulations or state parking regulations, including Section 61-8-353, Montana Codes Annotated, through Section 61-8-357, Montana Codes Annotated, the person in whose name the vehicle is registered shall be absolutely liable for the violation of such parking regulation and shall be subject to the penalty provided therefor.
B. Whenever evidence shows that the vehicle had been reported as stolen at the time in question, or was not parked illegally, or that he/she was not the registered owner of the vehicle at the time of the alleged violation, that person is absolved of responsibility for the particular offense.
C. Whenever any motor vehicle without a driver is found parked or left in violation of any provisions of the city parking regulations or state parking regulations, including those sections set forth in subsection A of this section, the police officer finding the motor vehicle shall take its registration or license number and any other information displayed on the vehicle which may identify its users or owner, and shall conspicuously affix to such motor vehicle a traffic citation, on a form provided by the police department, for the owner to answer to the charges against him/her within the time and at the place provided for in the citation.
D. Any person pleading guilty to or convicted of a motor vehicle violation of the city parking regulations, or the state parking regulations as set forth in this section, shall be subject to the penalty provisions of Section 61-8-711, Montana Codes Annotated.
