§ 90.88  Humane Care Of Animals
   (a)   It shall be unlawful for any person to fail to provide any animal in the person’s custody with sufficient good and wholesome food or water, adequate shelter and protection from weather, veterinary care when needed to prevent suffering, and with humane care and treatment.
   (b)   It shall be unlawful for any person to beat, cruelly treat, torment, mentally abuse, overload, overwork, or otherwise abuse an animal, or cause, instigate or permit any dog fight, cock fight, bull fight or other combat between animals or between animals and humans.
   (c)   It shall be unlawful for any person to abandon an animal in custody.
   (d)   It shall be unlawful for any person to sell, offer for sale, barter or give away any dyed, colored or otherwise artificially treated baby chicks, ducklings or other fowl, rabbits, hamsters, or any other animal.
   (e)   It shall be unlawful for any person to treat an animal in an inhumane or cruel manner as defined by V.T.C.A., Penal Code § 42.09 and V.T.C.A., Health and Safety Code Chapter 821.
