§ 173.10  Termination, suspension or resignation of members
   (a)   Membership of any volunteer firefighter in the Chico Community Volunteer Fire Department may be terminated by the Chief of the Volunteer Fire Department with approval of the City Council for any cause set forth in the "Operation Manual of the Chico Community Volunteer Fire Department".  The Chief and the City Council must both recommend and approve termination before any volunteer firefighter may be terminated.
   (b)   The Chief of the Volunteer Fire Department may suspend any volunteer firefighter for a period not to exceed sixty (60) days for any cause set forth in the "Operation Manual of the Chico Community Volunteer Fire Department."  If such suspension is imposed, the Chief shall, in writing, and within twenty-four (24) hours of the suspension, state the reasons for the suspension.  The volunteer firefighter shall be given a written reason within a reasonable period of time from the date of suspension.  The volunteer firefighter shall have the right to appeal as set out in the "Operation Manual of the Chico Community, Volunteer Fire Department."
   (c)   A member of the Chico Community Volunteer Fire Department may resign by delivering his written resignation to the Chief.  The resignation shall be effective upon acceptance by the City Council.
   (d)   The Chief of the Volunteer Fire Department may be terminated by the Mayor, upon recommendation of the City Council, for any reason set forth in the "Operation Manual of the Chico Community Volunteer Fire Department."
   (e)   The Mayor shall have the authority to suspend the Chief of the Volunteer Fire Department for a period not to exceed sixty (60) days for any reason deemed sufficient by the Mayor.  Prior to any suspension, the Mayor shall, in writing and within twenty-four (24) hours of the suspension, state the reasons for the suspension.  The Chief shall be given the written reasons within a reasonable period of time from the date of suspension.  The Chief shall have the right to appeal any suspension to the City Council if the suspension is not terminated prior to any regularly scheduled Council meeting or called Council meeting.  The right of appeal shall be set forth in the "Operation Manual of the Chico Community Volunteer Fire Department."
   (f)   If the Chief is suspended by the Mayor, the Mayor shall appoint a First Assistant Chief who shall serve until the suspension of the Chief is lifted or is otherwise disposed.
