Any unreasonable noxious, unpleasant, or strong odor which causes material distress, discomfort, or injury to persons of ordinary sensibilities in the immediate vicinity thereof is declared to be a nuisance and as such is liable to be abated and the person guilty of causing such odor shall upon conviction, be punished, as provided in § 10.10.
