3-9-1: DEFINITIONS:
Unless the context otherwise requires, the following words and phrases as used in this Chapter shall be construed according to the definitions set forth below:
ACT:
Tattoo and Body Piercing Establishment Registration Act (410 ILCS 54).
BODY ART:
The practice of physical body adornment, including, but not limited to, the following techniques: body piercing, tattooing, cosmetic tattooing, branding and scarification. This definition does not include practices that are considered medical procedures by the Illinois state medical board, such as implants under the skin, which shall not be performed in a body art establishment. Nor does this definition include piercing of the noncartilaginous portion or lobe of the ear with presterilized single use stud and clasp ear piercing systems.
BODY ART CODE:
Title 77, Chapter I, Subchapter m, Part 797 of the Illinois Administrative Code.
BODY ART ESTABLISHMENT OR ESTABLISHMENT:
A body piercing operation, a tattooing operation, or a combination of both operations in a multiple type establishment.
BODY ARTIST:
A person who conducts or practices body art activities and/or procedures.
BODY PIERCING:
Penetrating the skin to make a hole, mark, or scar that is generally permanent in nature. "Body piercing" does not include practices that are considered medical procedures or the puncturing of the noncartilaginous portion or lobe of the ear using a presterilized, single use stud and clasp ear piercing system.
OPERATOR:
An individual, partnership, corporation, association, or other entity engaged in the business of owning, managing, or offering services of body art.
PATRON:
The person who enters the premises and/or remains on the premises of an establishment with the consent of the operator, manager or other agent of the establishment. Anyone with an ownership interest, employees and agents of the operator shall not be considered patrons except when such persons are having any tattooing or body piercing done.
TATTOOING:
Any method of placing ink or other pigment into the skin or mucosa by the aid of needles or any other instrument used to puncture the skin, resulting in permanent coloration of the skin or mucosa. This term includes all forms of cosmetic tattooing. This term does not include the use, by a physician licensed to practice medicine in all its branches, of colors, dyes, or pigments for the purpose of obscuring scar tissue or imparting color to the skin for cosmetic, medical, or figurative purposes.
