9-8-5: FIRE-DAMAGED STRUCTURES:
   A.   Removal Of Fire-Damaged Structures: Any and all buildings within the City limits which have been or may hereafter be damaged by fire or storm or other casualty to the extent of fifty percent (50%) of its fair market value thereof as existed immediately prior to the casualty or onset of decay, shall be torn down or removed from the City by the owner thereof within thirty (30) days after being notified by the City to do so.    B.   Boarding Buildings: In addition, the owner shall board up burned or damaged buildings as necessary within seventy two (72) hours after the damage is sustained, or, in cases where the fire marshal conducts an inspection or investigation, within seventy two (72) hours after the fire marshal releases the building to the owner.
   C.   Selection Of Impartial Board:
      1.   In order to determine whether or not such building has been so damaged to the extent of fifty percent (50%) of the value thereof, as described above, the owner of any such building shall, if he does not believe the extent of damage exceeds fifty percent (50%) of its value, as described above, within ten (10) days after receiving notice by the City, notify the City thereof and select a disinterested party to act for him. The City shall select one such person to act for the City and the two (2) thus selected shall choose another such person to act for them, and the three (3) persons so selected shall constitute a board to determine the question and the decision of said board or majority thereof shall be binding upon all parties concerned.
      2.   Oath: The parties so selected shall first take and subscribe an oath that they will fairly and impartially estimate such damage and their decision, when reduced to writing and filed in the office of the City Clerk, shall be final.
      3.   Render Decision: The board shall act and render its decisions within thirty (30) days of appointment of all members.
   D.   Notices: Service of notices herein shall be made upon the owner of the building, or his agent or tenant, or in case no such owner, agent or tenant can be found, such notice shall be posted on the premises.
   E.   Violation, Penalty: Violations herein shall be subject to the general penalty provisions of this Code. (Ord. 327, 1995)
