(A) A person who owns land subject to this chapter must implement and maintain stormwater flow control measures in conformance with this chapter within ten days after a notice of violation has been given.
(B) Each violation, and every day upon which each violation occurs or continues to occur, constitutes a separate offense under this chapter.
(C) A person who fails to comply with this chapter and who, after notice, refuses to implement and maintain stormwater flow control measures and facilities in conformance with this chapter shall be subject to a civil infraction fine as established by City Council plus the cost of enforcement.
(D) Penalties for initiating earth change activities without a permit.
(1) Any earth change done without a required permit or in violation of a permit or permit condition is a violation of this chapter, and is subject to the penalties in this chapter.
(2) The enforcement agency will determine in writing by certified mail whether any earth change done without a required permit or in violation of a permit or permit condition requires site restoration and the applicable provision hereunder.
