No taxicab license or license for motor vehicle for hire shall hereafter be issued unless the Council shall, by resolution, declare that the public convenience and necessity require the proposed service for which application for license is made. Such declaration of public convenience and necessity shall not be necessary:
(A) For the licensing of the same number of taxicabs or motor vehicles for hire licensed for operation and operated under the same name and color on the 31st day of December, 1951, or the renewal of the same number of licenses annually thereafter; or
(B) For the renewal of licenses for which the Council shall have, at any time prior to the date of application for such renewal, made a declaration of public, convenience and necessity.
