§ 96.56  ESTABLISHMENT, MAINTENANCE AND OPERATION OF EQUIPMENT AND FACILITIES.
   (A)   It shall be the responsibility of the City Council to establish or expand the facilities of the Department, and may from time to time appropriate additional funds which may or may not be charged against the Department budget, but the Council may not delete the budget other than at the beginning of each quarter. The Commission or Director may make recommendations to the Council from time to time concerning the operation, maintenance, functions, etc. of the Department program or facilities.
   (B)   The Department shall have access to any city owned or leased equipment or property by consent of the City Manager or city Council for use in performing the Department's duties. The Department may utilize any authorized city personnel by consent of the City Manager or City Council for purposes of performing the Department's duties. The cost of utilizing the aforementioned equipment, property or personnel may or may not be charged against the Department's budget.
   (C)   The Director shall be responsible for the upkeep of all Department equipment and facilities.
