Sec. 3.8.  FILLING VACANCIES.
   If a vacancy occurs in the office of City Manager, the Council shall, within thirty (30) days after such vacancy occurs, appoint a person who possesses the qualifications required of the holder of that office.
   If vacancy occurs in any appointive office, other than those appointed by the Council, the City Manager shall within thirty (30) days thereafter, appoint a qualified person to fill such vacancy in the manner required for making the original appointment.
   If a vacancy should occur in the offices of a City Councilman or the Mayor, the remainder of the unexpired term shall be filled as follows:
   (a)   If twelve (12) months or less remain in the unexpired term, the City Council shall within thirty (30) days appoint a person having the same qualifications for such office to fill the remainder of the term.
   Provided, however, in the event that that office shall be that of the Mayor, the City Council may choose from its then existing members, one to fill the office of Mayor, in which case that councilman's position shall become vacant.
   (b)   If more than twelve (12) months remain in the unexpired term, the City Council shall within thirty (30) days appoint a person having the same qualifications for such office in the same method as provided in subsection (a) herein and schedule a special election as soon as permitted by law.
   Said person so appointed shall fill such vacancy for the unexpired term or until a successor has been elected, whichever occurs, and the same has qualified for and assumed the duties of his office.
   (c)   If other provisions of the City Charter or State Law shall prohibit the calling of such a special election, then the appointment shall be in effect until a special or general election is legally permitted whichever shall occur first.
