3-5-5: DENIAL OF PERMIT:
   A.   Upon the Village Clerk's review of the application, the Village Clerk may refuse to issue a permit to the applicant, and/or the employees or agents of the applicant, under this chapter for any of the following reasons: (Ord. 13-07, 8-5-2013; amd. 2019 Code)
      1.   The location and time of solicitation or peddling would endanger the safety and welfare of the solicitors, peddlers or their customers and/or violate the day and time restrictions imposed by this chapter.
      2.   An investigation reveals that the applicant, and/or the employees or agents of the applicant, falsified information on the application.
      3.   The applicant, and/or the employees or agents of the applicant, have been convicted of a sex offense, delivery or possession of controlled substances, any violent acts against persons or property or any offense involving fraud or misrepresentation.
      4.   The applicant, and/or the employees or agents of the applicant, are persons against whom a civil judgment has been entered based upon any acts involving theft, fraud, deceit or misrepresentation.
      5.   There is no proof as to the authority of the applicant to serve as an agent to the principal.
      6.   The applicant, and/or the employees or agents of the applicant, have had an application denied under this chapter, unless the applicant, and/or the employees or agents of the applicant, can and do show, to the satisfaction of the Village Clerk, that the reasons for such earlier denial no longer exist.
      7.   The applicant, and/or the employees or agents of the applicant, have previously been issued a permit by the Village and failed to comply with the ordinances of the Village.
      8.   The applicant, and/or the employees or agents of the applicant, are unable to show proof of possession of a license or permit which, under Federal, State or local law, they are required to have in order to conduct their business or profession, such license or permit to include specifically, but without limitation, an Illinois Business Tax number issued by the Illinois Department of Revenue.
   B.   The Village Clerk's disapproval and the reasons for disapproval shall be noted on the application, and the applicant shall be notified that his application is disapproved and that no permit will be issued. Notice shall be mailed to the applicant at the address shown on the application form or at the applicant's last known address. (Ord. 13-07, 8-5-2013)
