§ 93.07 ABOVEGROUND AND UNDERGROUND TANK INSTALLATION.
   (A)   Before any aboveground or underground tank used for the storage of volatile flammable or combustible liquids or any other hazardous material covered by the provisions of this code shall be installed, a permit must be issued and shall be granted only upon written application made to the County Fire Marshal's Office setting forth therein the location, character, size/capacity and purpose of which it is to be used and an agreement that the applicant, or user will conform to all the provisions of this code and the ordinances then existing, and in case a pump is to be used in connection therewith, the application shall state its location with respect to the tanks and with respect to all property lines.
   (B)   The Fire Marshal and/or his or her authorized representative shall determine whether the proposed tanks comply with the provisions of this code, the ordinances of the county, laws of the state, and shall issue the permit if he or she finds there is compliance.
   (C)   The Fire Marshal and/or his or her authorized representative shall have the right to inspect the tanks and ancillary equipment before and after installation, and ensure that its location, installation and operation are in accordance with this code, the ordinances of the county and laws of the state.
   (D)   After the tank is placed in the excavation, and fittings and connections have been attached, thereto, and before it has been covered or concealed from inspection, the applicant for the permit shall notify the Fire Marshal and/or his or her authorized representative and shall wait until the installation of the tank connections and fittings have been approved by the Fire Marshal and/or his or her authorized representative before covering them.
      (1)   Aboveground fuel storage tanks may be installed at automotive service stations when installed in strict compliance with the applicable requirements of NFPA #30 and NFPA #30A.
      (2)   Unattended service stations open to the public for the dispensing of motor fuels shall be allowed providing they meet all of the applicable requirements of Chapter 22 of the State Fire Prevention Code of the State Building Code most current edition and this code.
