(A) Any person violating any provision of this chapter, or aiding, or causing another person to violate this chapter, shall be subject to a fine in an amount of not less than $25 nor more than $100. Each violation is considered a separate offense. Each day any violation continues shall also constitute a separate offense. It is the intent of the city that persons committing repeated or multiple violations should be fined more severely.
(B) In addition to any other civil or criminal penalties which may be imposed for violation of this chapter, a person littering shall be responsible for the costs of cleaning up any solid waste dumped on any public or private property, as well as all costs incurred in enforcing this provision of this chapter.
(C) A citation or notice showing a violation of this chapter and a fine can be issued by the Director of the Sanitation Department, Sanitation Department employees, the Building Commissioner, City Police Officers, or any other city official authorized by the Board of Public Works and Safety.
(D) A citation or notice showing a violation of this section can be served upon the owner of real property where a violation has or is occurring by mailing or delivering a copy to the address listed at the office of the Auditor of Clark County, Indiana, as the owner's address, as well as personally, or by posting a citation or notice at the location of an ongoing violation.
