(A) Grease traps or grease interceptors shall be provided as required by §§ 52.005 and 52.041 of the Code of Ordinances of the City of Charlestown, Indiana (referenced and incorporated herein) (the “Code”) and in accordance with the Indiana Plumbing Code (675 IAC 16-1.4), as it may be amended from time to time (the “Indiana Plumbing Code”). Grease traps and grease interceptors shall also be provided for all food handling establishments or any other establishments where grease, fats, or oils may be introduced into the drainage sewerage system in quantities that can affect line stoppages or hinder sewage treatment. These establishments include but are not limited to restaurants, cafes, lunch counters, cafeterias, bars and clubs, hotels, hospitals, sanitariums, factories, churches, retirement homes, school kitchens, grocery stores, gas stations, car washes, and auto maintenance shops (collectively, “establishments” and “establishment” in the singular).
(B) Design of grease traps or grease interceptors shall be determined by Indiana Plumbing Code requirements.
(C) Grease traps and grease interceptors shall be located outside of an establishment for ease of access and inspection unless another location is approved in writing by the Utility Director.
(D) Grease trap and grease interceptor inspection and acceptance by the Utility Director for new establishments shall be required prior to issuing approval to open.
(E) Frequency of cleaning and maintenance for grease traps and grease interceptors shall be at a minimum of every 180 days or sooner if deemed necessary by the Utility Director or by volume of collected material.
(F) Records of cleaning and maintenance shall include but not be limited to:
(1) Date of service;
(2) Description of service;
(3) A minimum of three years of records shall be maintained and available for review;
(4) Identity of person performing the service; and
(5) Method and location of grease disposal.
(G) Any establishment found in violation of this section may be fined as detailed below:
(1) First offense: Fine of $250.
(2) Second offense: Fine of $250.
(3) Third offense: Fine of up to $1,000 per day until the violation is addressed and remedied.
(4) If additional violations occur, the Sanitary Sewer Board may, in its discretion, disconnect the establishment from the City of Charlestown's sanitary sewer system.
(H) Modifications or exceptions to this section must have the approval of the Utility Director and the Sanitary Sewer Board, and must not be in conflict with the Indiana Plumbing Code.
(I) Establishments shall be in compliance with the requirements herein by January 1, 2025.
(J) Any terms not defined herein shall have the meanings set forth in the Indiana Plumbing Code or Chapter 52 of the Code.
