9-3-2: AMENDMENTS TO CODE:
Modifications to the text of the international fire code, 2009 edition, are as follows:
101.1 Title: Insert city of Charleston (name of jurisdiction).
105.7.12 Open Burning Permits is hereby added to the code as follows:
105.7.12: Permits shall be required for open burning.
108.4 A new section 108.4 shall be inserted as follows:
F-108.4 Fee For Appeal: Fee for an appeal shall be one hundred fifty dollars ($150.00).
109.2.3 Prosecution Of Violations is hereby deleted and the following inserted in lieu thereof:
109.2.3 Failure To Correct Violations: If the notice of violation is not complied with within the time specified by the code official, the code official shall request legal counsel of the jurisdiction to institute the appropriate legal proceedings to restrain, correct or abate such violation or to require removal or termination of the unlawful occupancy of the structure in violation of the provisions of this code or of any other order or direction made pursuant thereto.
109.3 Violation Penalties is hereby deleted and the following inserted in lieu thereof:
109.3 Violation Penalties: Any person who shall violate a provision of this code or shall fail to comply with any requirements thereof, or who shall erect, construct, alter or repair building or structure in violation of an approved plan or directive of the building official or a permit or a certificate issued under the provision of the code shall be guilty of a petty offense, punishable by a fine of not more than seven hundred fifty dollars ($750.00) nor less than fifty dollars ($50.00) at the discretion of the court. Each day said violation exists shall be deemed a separate offense.
111.4 Failure To Comply: Insert not less than $50.00 or more than $750.00 dollars for amount.
401.6 New section inserted:
401.6 Assembly Counts: The owner/occupant/manager of a place of assembly shall not cause or allow the number of occupants to exceed the occupancy limit determined by the fire and building officials. Allowing the number of occupants to exceed the posted occupancy limit shall be considered a violation of this code.
505.1.1 New section inserted:
505.1.1 Identification Of Commercial Businesses: All commercial/business structures accommodating more than one business in the same building must identify the rear, side or any exterior access doors in contrasting letters in a permanent and legible manner with individual letters not less than two inches (2") in height indicating the business/occupant name.
505.1.2 New section inserted:
505.1.2 Identification Of Gas And Electric Meters: Grouped gas or electric meters shall have signage designating the business to which they correspond.

903.2.7 Is hereby deleted and the following inserted in lieu thereof:
903.2.7 Group M. An automatic sprinkler system shall be provided throughout buildings containing a group M occupancy where one of the following conditions exist:
      1.   A group M fire area exceeds 12,000 square feet (1115 m2).
      2.   A group M fire area is located more than three stories above grade plane.
      3.   The combined area of all group M fire areas on all floors, including any mezzanines, exceeds 24,000 square feet (2230 m2).
      4.   A group M occupancy used for the display and sale of upholstered furniture or mattresses exceeds 5,000 square feet (464 m2).

906.1 Add new subsection 7:
Portable fire extinguishers shall be provided in the kitchen area of individual dwelling units and shall carry a minimum rating of not less than 2A 10BC. Exception: In structures having common hallway fire extinguishers of appropriate rating, and travel distance shall be acceptable upon approval of the official having jurisdiction.
3204.3.1.1 Is deleted and the following inserted in lieu thereof:
3204.3.1.1 Location: Stationary containers shall be located in accordance with section 3203.6. Containers of cryogenic fluids shall not be located within diked areas containing other hazardous materials.
Storage of flammable cryogenic fluids in stationary containers outside of buildings is prohibited in all zoning districts of the city of Charleston except the I-2, heavy industrial district.
3301.1 Scope is hereby deleted and the following inserted in lieu thereof:
3301.1 Scope: The manufacturer, display, sale, or discharge of fireworks shall comply with the provisions of this chapter and 425 Illinois Compiled Statutes chapter 30/1 et seq. cited as the fireworks regulation act of Illinois.
3301.1.3 Fireworks is hereby deleted and the following inserted in lieu thereof:
3301.1.3 Fireworks: The possession, manufacture, storage, sale, handling and use of fireworks are prohibited except as authorized by 425 Illinois Compiled Statutes chapter 30/1 et seq.
3302.1 Definitions is hereby modified by the deletion of the definition of fireworks and the following substituted in lieu thereof:
3302.1 Definitions: Fireworks: Fireworks shall mean and include any explosive composition or any substance or combination of substances, or article prepared for the purpose of producing a visible or audible effect of a temporary exhibitional nature by explosion, combustion, deflagration or detonation and shall include blank cartridges, toy cannons in which explosives are used, the type of balloons which require fire underneath to propel the same, firecrackers, torpedoes, sky rockets, roman candles, bombs or other fireworks of like construction and any fireworks containing any explosive compound; or any tablets or other device containing any explosive substance, or containing combustible substances producing visual effects. The term "fireworks" shall not include snake or glowworm pellets; smoke devices; sparklers; trick noise-makers known as "party poppers", "booby traps", "snappers", "trick matches", "cigarette loads", and "auto burglar alarms"; toy pistols, toy canes, toy guns, or other devices in which paper or plastic caps containing .25 grains or less of explosive compound are used, provided they are so constructed that the hand cannot come in contact with the cap when in place for the explosion; and the toy pistol paper or plastic caps which contain less than .25 grains of explosive mixture; the sale and use of which shall be permitted at all times.
3804.2 Is hereby deleted and the following inserted in lieu thereof:
3804.2 Maximum Capacity Within Established Limits: The aggregate capacity of any one installation shall not exceed a water capacity of 2,000 gallons except in the I-2, heavy industrial district of the city of Charleston zoning map.
