3-3-4: INELIGIBILITY FOR LICENSE:
No license shall be issued to:
   A.   A person that has not designated a resident of the City to receive any and all notices and communications on its behalf. (Ord. 19-O-1, 1-2-2019)
   B.   A person not of legal age, or under any legal disability.
   C.   A person who is not of good character and reputation in the community in which he resides.
   D.   A person who is not a citizen of the United States.
   E.   A person who has been convicted of a felony under any Federal law or under the laws of the State.
   F.   A person who has been convicted of being the keeper or is keeping a house of ill fame.
   G.   A person who has been convicted of pandering or other crime or misdemeanor opposed to decency and morality.
   H.   A person, partnership, LLC, or corporation whose license issued under this chapter has been revoked for cause.
   I.   A person, partnership, LLC, or corporation who at the time of application for renewal of any license issued hereunder would not be eligible for such license upon a first application.
   J.   A partnership, LLC, or corporation unless its place of business is conducted by a manager or agent and said manager or agent possesses the same qualifications required of a person licensed as a sole proprietor.
   K.   A person whose place of business is conducted by a manager or agent, unless said manager or agent possesses the same qualifications required of a person licensed as a sole proprietor.
   L.   A person who has been convicted of a violation of any Federal or State law concerning the manufacture, possession or sale of alcoholic liquor after the effective date hereof, or shall have forfeited his bond by failure to appear in court to answer charges for any such violation.
   M.   A person, partnership, LLC, or corporation who does not own the premises for which a license is sought, or does not have a lease thereon for the full period for which the license is to be issued.
   N.   Any law enforcing public official, any Mayor, or member of the City Council or commission, and no such official shall be interested in any way, either directly or indirectly, in the manufacture, sale or distribution of alcoholic liquor.
   O.   Any person, partnership, LLC, or corporation not eligible for a State retail liquor dealer's license.
   P.   Any person, partnership, LLC, or corporation whose principal business in the premises described in the application is the sale at retail or wholesale of dry goods.
   Q.   Any person, partnership, LLC, or corporation who fails to furnish or furnishes false information or who fails to make or falsely makes statements required in the application for license as set forth in this chapter.
   R.   No person, individually or as a partner or shareholder in any corporation, shall own any interest in more than five (5) licenses issued hereunder. (Ord. 18-O-32, 11-6-2018)
