The Community Development Administrator or designee may seek forfeiture of the balance of the deposit if construction has not been completed, more than 12 months have passed since all or part of the deposit was made and the deadline imposed in the Municipal Approval has passed. The owner of the deposited funds shall be given written notice by certified mail sent at least 14 days prior to the hearing before Council and shall be given an opportunity to present evidence why the deposit should not be forfeited. Council may declare the deposit forfeited to the Municipality after a public hearing.
