1123.15 NONCONFORMING SITE CONDITIONS EXISTING AT TIME OF DEVELOPMENT PLAN REVIEW.
   If a lot or use is nonconforming when a revised development plan required by Chapter 1111 (Development Approval Process) is submitted, the revised plan shall correct the non-conforming conditions and propose a development which complies with the zoning district requirements. The developer or applicant may apply to the Planning Commission for a variance from the Code requirements due to practical difficulties as a result of site conditions such as the configuration of the development parcel and nature of surrounding development; location of existing structures on the site; location of parking and access to the site; and location of utilities both on and off-site.
