§ 115.17 REVOCATION OR SUSPENSION.
   (A)   The Village President or the Village President's designee shall have the authority to revoke a license for any one or more of the following reasons:
      (1)   The owner or operator or employee of the licensed business knowingly allowed a person under 18 years of age to enter the business;
      (2)   The licensed business does not conform to the provisions of this chapter or is in violation of any other applicable federal, state, or local law or regulations;
      (3)   The owner or operator of the licensed business gave materially false, fraudulent, or untruthful information on the original or renewal application form;
      (4)   The business has been closed for business for a period of 30 consecutive days, unless such closure is due to circumstances beyond the control of the owner, and the owner is proceeding with due diligence, given all attendant circumstances, to re-open the business;
      (5)   The operator or owner becomes ineligible to obtain a license;
      (6)   Any cost, bill, or fee required to be paid by this chapter or any other village ordinance is not paid;
      (7)   Any alcoholic beverage is served or consumed on the premises of the sexually oriented business;
      (8)   Any other act or omission which demonstrates the owner's or operator's inability to operate the sexually oriented business in accordance with applicable law.
   (B)   Prior to revocation or suspension of a license, the Village President or the Village President's designee shall investigate whether probable cause for revocation or suspension may exist and if so, shall notify the licensee in writing of reasons for the proposed revocation or suspension and grant such licensee the opportunity to appear before the Village President or the Village President's designee at a time and place specified within such notice. Such hearing shall be held not less than 15 days after the notice is given. Hearings shall be conducted under rules issued by the Village President. Such rules shall be consistent with the nature of the proceedings and shall ensure that each party may present evidence, cross-examine witnesses, and be represented by legal counsel. If, after the hearing, the Village President or the Village President's designee finds that the license should be revoked or suspended the Village President or the Village President's designee shall issue a written order revoking or suspending such license which shall be effective on the third day after notice thereof is given to the owner or operator.
