§ 151.98 MEANS OF APPEAL.
   (A)   The owner of a building or structure or any other duly authorized agent may appeal in writing any decision of an inspector to the Village of Channahon within 30 days from the date of said decision by the filing of a written notice with the Village Clerk. Failure to file a written appeal within the time set forth shall cause the decision or order issued to become final and shall preclude any right of appeal. Application for appeal may be made when it is claimed that the true intent of this chapter or the rules legally adopted thereunder have been incorrectly interpreted; that the provisions of this chapter do not fully apply; or that an equally good or better form of construction can be used.
   (B)   An appeal shall stay all proceedings in furtherance of the decision appealed from unless the inspector certifies to the Village of Channahon, after the notice of appeal has been filed with him, that by reason of facts stated in the certificate a stay would, in his opinion, cause imminent peril to life or property, in which case the proceedings shall not be stayed otherwise than by a decision granted by the Village of Channahon or by a restraining order issued by a court of record upon application following notice to the inspector and upon de cause shown. The Village of Channahon shall select a reasonable time and place for a public hearing on the appeal, shall give due notice thereof to the parties having a known interest therein and shall render a written decision within 60 days of the filing of the notice of appeal. Upon the occurring vote of a majority of its members, the Village of Channahon may reverse or affirm, in whole or in part, or may modify the decision from which the appeal was taken and to that end the powers of the Building Inspector or the Septic, Plumbing, or Electrical Inspectors with respect to such decision.
   (C)   All decisions and findings of the Village of Channahon on appeals or upon applications for a variation, after a hearing shall, in all instances, be final administrative decisions and shall be subject to judicial review as the law may provide.
   (D)   The Village of Channahon may adopt additional rules, regulations, and procedures for the hearing of said appeals.
