§ 151.34 FIRE PROTECTION DISTRICT FEES.
   (A)   As a condition to the issuance of a building permit for any residential dwelling unit, the building permit applicant shall pay to the village a fire protection district fee. Such fee shall be collected by the village for the benefit of the fire protection district in whose jurisdiction the property is situated. The actual amount of fees collected shall be paid over to the applicable fire protection district annually.
   (B)   The amount of fees shall be determined as follows:
      (1)   All attached residential dwelling units - $400 per dwelling unit;
      (2)   All detached residential dwelling units - $400 per dwelling unit; and
      (3)   All other buildings or structures including, but not limited to, commercial, industrial and non-residential $0.05 per square foot of total building area.
   (C)   The village shall not collect funds under this chapter for any taxing body which does not, prior to the effective date of this section, enter into an Intergovernmental Agreement with the village which provides that such taxing body will hold harmless, indemnify and release the village upon such terms and conditions as are acceptable to the village.
   (D)   Each district receiving funds under this section shall annually make a written report to the village detailing the amount of funds received and how such funds were expended. This report shall be provided to the village prior to December 31 of each year.
   (E)   The village shall review this section every three years to determine whether the cash contribution herein set forth is consistent with current criteria.
   (F)   All fees collected under this section shall only be expended toward the purchase of capital improvements, including but not limited to, property acquisition, construction of structures, additions and improvements to existing structures, purchase of fire apparatus and purchase of ambulance or other rescue equipment.
