§ 159.06 APPLICATION AND STANDARDS OF APPROVAL.
   (A)   Application requirements. The following shall apply for all required submittals and applications:
      (1)   Towers, PWF and PWF support structures.
         (a)   A scaled site plan.
         (b)   Legal description and survey of the parent tract and leased parcel or subdivision plat.
         (c)   All setbacks required by this chapter must be depicted on the survey and site plan.
         (d)   A landscape plan in accordance with the Chapter 158 of this code.
         (e)   Fence detail with color, heights, type of material.
         (f)   A description of compliance with this chapter and all applicable federal, state, or local laws.
         (g)   A notarized statement by the applicant as to whether construction of the tower will accommodate collocation of additional antennas for future users.
         (h)   A statement that the proposed facility meets all FAA, FCC and other applicable standards and regulations.
   (B)   Special use permit base standards in addition to all other requirements. In the case where a special use permit is required the facility must meet all of the following requirements.
      (1)   The use will not materially endanger the public health or safety if location where proposed and developed according to the plan submitted.
      (2)   The use meets all required conditions and specifications.
      (3)   The petitioner has satisfied the co-location requirements listed herein.
      (4)   The use will not substantially injure the value of adjoining or abutting property unless the use is a public necessity.
      (5)   The use meets all FAA and FCC standards and other applicable federal, state, or other standards.
      (6)   The location and character of the use, if developed according to the plan as submitted and approved, will be in harmony with the area in which It is to be located and will be in conformity with the general plan of development for the area.
      (7)   The separation distance from other towers or PWF's shall not be less than 1,500 feet. If less, the applicant must provide evidence that the existing tower cannot accommodate the new request.
      (8)   Applicants are required to demonstrate by providing proof of certified mailings or other reasonable means:
         (a)   That they contacted the owners of reasonably suitable structures which are ten feet less than the design height of the tower within a one-quarter mile radius of the site proposed and which from a location standpoint could provide part of a network for transmission of signals;
         (b)   Have asked for permission to install the antenna on those structures; and
         (c)   Were denied for reasons other than economic feasibility.
