§ 95.13 APPROVAL OR REJECTION OF APPLICATION; ISSUANCE OF PERMIT.
   (A)   The application and the report of the Village Engineer shall be submitted to the Director of the Department of Roads and Drainage for approval or rejection. The applicant shall also furnish the village with a bond or letter of credit in a form approved by the Village Attorney with good and sufficient corporate surety so as to reimburse the village for the cost of any and all repairs and related expenses such as reasonable engineering and attorney's fees incurred by the village for the maintenance and repair of the street, alley or highway as a result of said cutting or excavation within a period of two years of the completion of such cutting or excavation and written approval of the Village Engineer. Any bond or letter of credit shall be in a sum equal to one and one-half times the amount of the estimate of the Village Engineer of the maximum possible damage as aforesaid. The applicant shall also indemnify and hold harmless the village, its officers, elected and appointed officials and agents of and from any and all claims, causes of action, judgments, damages and the like which arise out of or from the cutting or excavation of any street, alley or highway in the village.
   (B)   A permit shall be issued by the Village Clerk upon the direction of the Director of the Department of Roads and Drainage when such cutting or excavation is reasonably necessary and all other provisions of this subchapter have been satisfied. The permit will terminate and will not be valid if the cutting or excavation has not commenced prior to the expiration of six months from the date of issuance.
