§ 156.191 ZONING ENFORCEMENT OFFICER.
   (A)   The position of Zoning Enforcement Officer is hereby created in which is vested the power and duty to administer and enforce all the provisions of this section of the Zoning Ordinance and such related regulations as are so assigned by the Corporate Authorities.
   (B)   The President with the advice and consent of the Board of Trustees shall appoint the Zoning Enforcement Officer. The Corporate Authorities may also provide for the appointment of such deputies as are needed and qualified to carry out efficiently the duties and powers of the position. The Zoning Enforcement Officer shall hold said position concurrently with the term of the Village President or until his successor is duly appointed and qualified.
   (C)   The powers and duties of the Zoning Enforcement Officer are as follows:
      (1)   Conduct inspections of buildings, structures and land to determine compliance with this Ordinance and notify in writing the person responsible for any violation found, indicating the nature of the violation and ordering the action necessary to correct it.
      (2)   Order the discontinuance of illegal use of land, building or structures or any illegal work being done; removal of illegal buildings or structures or of illegal additions, alterations or structural changes; and any other action authorized by statute or by this Ordinance to ensure compliance with or to prevent violation of its provisions.
      (3)   Prepare and cause to be published, on or before March 31 of each year, a map showing the existing zoning uses, divisions, restrictions, regulations and classifications in effect on the preceding December 31.
      (4)   Maintain permanent and current records of this section, including, but not limited to, all maps, amendments, special use permits, planned unit developments, variations, appeals and applications therefore.
      (5)   Initiate, direct and review from time to time a study of the provisions of this Ordinance and make recommendations to the Planning and Zoning Commission as such study requires.
      (6)   Keep the Board of Trustees advised of zoning activities.
      (7)   Enforce all provisions of this Ordinance.
      (8)   Make a written report to the President and Board of Trustees once each month, or oftener if requested, including statements of permits and certificates issued and orders promulgated.
      (9)   Be an exofficio nonvoting member of the Planning and Zoning Commission.
      (10)   Perform such other duties as may be prescribed from time to time by the Corporate Authorities.
   (D)   Before entering upon the duties of Zoning Enforcement Officer, the Zoning Enforcement Officer shall take and subscribed to the following oath:
I,                  , do solemnly swear (or affirm) that I will support the Constitution of the United States and the Constitution of the State of Illinois and that I will faithfully discharge the duties of Zoning Enforcement Officer of the Village of Channahon according to the best of my ability.

The oath, so subscribed, shall be filed in the office of the Village Clerk.
   (E)   Before entering upon the duties of Zoning Enforcement Officer, he shall execute a bonds with security to be approved by the Corporate Authorities payable to the Village of Channahon in the amount of $3,000.00 conditioned upon the faithful performance of the duties of Zoning Enforcement Officer and the payment of all money received by him. The premium for said bond shall be paid by the Village of Channahon and the bond filed with the Village Clerk.
   (F)   Compensation of the Zoning Enforcement Officer and payment of any expenses shall be as provided for from time to time by the Corporate Authorities in a separate ordinance.
   (G)   If the Corporate Authorities determine that the Zoning Enforcement Officer was acting in good faith and without malice as a result of any act required or permitted in the discharge of his official duties, any suit instituted against the Zoning Enforcement Officer or deputy shall be defended by the Village Attorney or the attorney for any insurance company representing the Village, as the case may be, until the final termination of the proceedings including any appeals. The Village shall also pay for all court costs of the proceeding.
   (H)   The Zoning Enforcement Officer shall carry proper credentials for the performance of his duties under this ordinance. In the discharge of his duties, the Zoning Enforcement Officer, his authorized representative or any other qualified Village Inspector or deputy shall have the authority to enter at any reasonable hour any building, structure or premises in the Village of Channahon to enforce the provisions of this ordinance. The assistance and cooperation of police, fire and health departments and all other officials shall be available to him as required in the performance of his duties.
   (I)   The Zoning Enforcement Officer shall have power as may be necessary in the interest of public safety, health and general welfare to adopt and promulgate written rules and regulations to interpret and implement the provisions of this ordinance to secure the intent thereof and to designate requirements applicable because of local climatic or other conditions. Such rules shall not have the effect of waiving working stresses or fire resistive requirements specifically provided in this ordinance or violating accepted engineering practice involving public safety.
   (J)   The Zoning Enforcement Officer shall deliver and return all books, records, papers and other matters relative to his position to the Village Clerk upon termination with the Village of his position as Zoning Enforcement Officer.
