§ 52.064 NOTICES OF VIOLATION.
   (A)   Whenever and wherever it shall appear that any person is violating any of the provisions of this chapter or other related ordinances, laws or administrative regulations, other than failure to pay water charges, the Director may (but is not required as a condition precedent to prosecution for violation) cause to be served, personally or by certified mail, return receipt requested, upon the alleged offender a notice in writing stating the date, nature of the alleged offense and directing that the same cease and desist immediately upon service of the notice, and that the act or omission causing such violation be corrected within such reasonable time as the circumstances may require.
   (B)   The failure, neglect and refusal of the person alleged to be in such violation to cease and desist therefrom within the time stated in such notice shall be deemed a violation of the provisions of this chapter and punishable as provided in this chapter and/or termination of water service.
