3-2-30: EIGHT HOUR DAY; LABORERS, CONTRACTS:
   A.   Laborers, Mechanics, Janitors:
      1.   Eight (8) hours shall constitute a day's work for all laborers, workers, mechanics, janitors of public institutions or other persons now employed or who may hereafter be employed by and in behalf of the city, except in cases where it may be necessary to work for more than eight (8) hours per calendar day for the protection of property or life. However, in all such cases, laborers, workers, mechanics or other persons so employed and working to exceed eight (8) hours per calendar day shall be paid on a basis of eight (8) hours constituting a day's work.
      2.   Not less than the current rate of per diem wages in the locality where the work is performed shall be paid laborers, workers, mechanics, janitors of public institutions or other persons so employed by or on behalf of the city. Laborers, workers, mechanics or other persons employed by contractors or subcontractors in the execution of any contract or contracts with the city shall be deemed to be employed by or on behalf of the city.    B.   Contracts:
      1.   All contracts hereafter made by or on behalf of the city with any corporation, person or persons, for the performance of any work, by or on behalf of the city, shall be deemed and considered as made upon the basis of eight (8) hours constituting a day's work.
      2.   It is unlawful for such corporation, person or persons to require, aid, abet, assist, connive at, or permit any laborer, worker, mechanic, janitor at public institutions, or other person to work more than eight (8) hours per calendar day in doing such work, except in cases and upon the conditions described in subsection A of this section.
      3.   The provisions of this chapter in regard to hours worked per calendar day shall not apply to the construction, reconstruction, maintenance, or the production of local materials for: highways, roads, streets and all the structures and drainage in connection therewith; sewer systems; waterworks systems; dams and levies; canals, drainage ditches; airport grading, drainage, surfacing; seeding and planting.
      4.   Provided, that the provisions of this chapter will not prevent employees from drawing time and a half for those hours worked over forty (40) during any calendar week. (1985 Code § 7-332)
