3-2-28: EMERGENCY CONTRACTS:
   A.   Definition: "Emergency" as used in this section shall be limited to conditions resulting from a sudden unexpected happening or unforeseen occurrence or condition and situation wherein the public health or safety is endangered.
   B.   Notice And Bidding Not Required: The provisions of this chapter with reference to notice and bids shall not apply to an emergency if:
      1.   The city council declares by a two-thirds (2/3) vote of all of the members of the council that an emergency exists; or
      2.   The city manager declares an emergency exists and the contract does not exceed thirty five thousand dollars ($35,000.00) in amount; provided however, that if the city manager declares such an emergency, he shall notify the city council of such action within ten (10) days. Such notification shall contain a statement of the reasons for his action, and shall be recorded in the official minutes of the council.
   C.   Reasons Entered Into Minutes: The reasons for declaring an emergency and not complying with the provisions of this chapter shall be entered into the official minutes of the city council. (Ord. 2002-01, 2-5-2002)
