11-3-4: POWERS:
The planning commission shall have the following powers:
   A.   Regulations: To consider and make recommendations on any proposed changes to the regulations of this zoning code, or any amendment to or other change in the various zoning districts or zoning maps.
   B.   Special Uses: To permit and authorize the uses listed in chapters 6 through 10 of this title, the specific district regulations as "uses permitted on review". These uses are so classified because they more intensely dominate the area in which they are located than do other uses permitted in the district; however, the nature of such uses may make it desirable that they be permitted to locate therein. The following procedure is established to integrate properly the uses permitted on review with the other land uses located in the district. These uses shall be permitted and authorized or rejected under the following procedure:
      1.   An application shall be filed with the planning commission for review. For each application for a special permit under "uses permitted on review", a fee in an amount fixed by city council resolution shall be paid to the city clerk. Said application shall show the location and intended use of the site, the names of all the property owners and existing land uses within three hundred feet (300'), and any other material pertinent to the request which the planning commission may require.
      2.   The planning commission shall hold one or more public hearings thereon in conformity with state law.
      3.   The planning commission shall, within forty five (45) days of the date of application, study the effect of such proposed building or use upon the character of the neighborhood, actual and anticipated traffic conditions, public utilities, the supply of light and air to adjacent property, the public safety from fire and other hazards, the established property values within the surrounding area, and upon other factors relating to the public health, safety, comfort, morals and general welfare of the people of the city, and authorize or deny the issuance of a permit for the use of land or buildings as requested. In making any determination whether uses permitted on review may be allowed in any particular location within a zoning district as more fully described in this title, the spirit of this zoning code must be preserved, but the special dominance or problems associated with a particular use may be mitigated if conditions or additional restrictions are imposed. The planning commission may consider such conditions and restrictions, so long as similar special uses are given the same, nondiscriminatory consideration. All such requirements relative to such property shall be such as is necessary and convenient to carry out the purpose and intent of this title.
   C.   Plats: To review all preliminary plats and all final plats, rendering such advice and recommendations to the city council as may be reasonable and appropriate to carry out the purposes of this title. (Ord. 2007-06, 4-2-2007)
