8-4-1: DEFINITIONS:
For purposes of this chapter, including articles A and B, the following terms shall have the meanings respectively ascribed to them in this section:
AIRCRAFT: Pertains to all aircraft including, but not limited to, airplanes, seaplanes, helicopters, ultralight aircraft, motorized hang gliders, hot air balloons, any nonpowered flight devices or any other flight equipment.
BEACH OR SWIMMING AREA: Designated areas which include the actual sand beach and adjoining land area and facilities, as well as the adjacent waters used for bathing, swimming and wading.
BUOY: An anchored marker for marking a position on the water, or a hazard, shoal or mooring, or any other prohibitive activity area.
CAMPING: Utilization of any piece of equipment for sleeping in or upon including, but not limited to, a sleeping bag, hammock, station wagon, car, van, motor home, bus, trailer, tent, tarp, truck, house vehicle, or pickup camper for the purpose of occupying a portion of public lands for temporary outdoor living.
CAMPSITE: Each small section of the camping area that contains a single fire ring.
CHANDLER AND BELL COW LAKES: The waters, lands and properties owned or controlled by the Chandler municipal authority or city of Chandler.
CHIEF OF POLICE: That person designated by the city manager to be responsible for the supervision of law enforcement activities which include the lakes.
CLASS A VESSEL: A vessel which is less than sixteen feet (16') in length.
CLASS 1 VESSEL: A vessel which is sixteen feet (16') or longer and less than twenty six feet (26') in length.
CLASS 2 VESSEL: A vessel which is twenty six feet (26') or longer and less than forty feet (40') in length.
CLASS 3 VESSEL: A vessel which is forty feet (40') or longer in length.
CLOSED ZONE: Any water or land area wherein the presence or operation of all watercraft or other use is prohibited and marked by appropriate means in accordance with the uniform waterway marking system or other means.
DESIGNATED AREAS: Any location, place, site, region, facility, zone, or space identified as such by the city manager or a designee.
DOCK: That part of a structure which may be used for the temporary mooring of watercraft.
FACILITY: Includes all or any part of structures, equipment or other real or personal property or interest therein, and the provisions of the facilities.
FIRE CHIEF: That person designated by the city manager as the chief of the Chandler fire department which includes jurisdiction of the lakes.
HORSEPOWER: The horsepower rating published by the manufacturer for the power unit involved.
JET SKI DEVICE: A fuel powered outboard or inboard class A motorboat as defined in 63 Oklahoma Statutes section 4002, which uses an internal combustion engine powering a water jet pump as its primary source of propulsion.
JUVENILE: Any person who has not attained their eighteenth birthday.
LAKE MANAGEMENT AREA: The approximate two thousand two hundred fifty (2,250) acres of Bell Cow Lake lands owned by the Chandler municipal authority and the approximate five hundred (500) acres of Chandler Lake land owned by the city.
LAW ENFORCEMENT OFFICER: The person(s) designated by the chief of police to enforce the laws, rules, and regulations at the lakes and to issue citations or effectuate arrests for violations of game, fishing, boating and other violations of city ordinances.
LENGTH OF BOAT: Refers to the overall length of the hull, extending from end to end over the deck, excluding sheer, measured in a straight line from the foremost part of a vessel and parallel to the centerline. Bow sprits, bumpkins, rudders, outboard motor brackets and similar fittings or attachments are not included in the measurement. Length shall be stated in feet and inches. Class A boats are under sixteen feet (16'). Class 1 boats are between sixteen (16) and twenty six feet (26'). Class 2 boats are between twenty six (26) and forty feet (40'). Class 3 boats are above forty feet (40'). Class 2 and 3 boats are prohibited on city lakes.
MINOR: Any person over sixteen (16) years of age but under eighteen (18) years of age.
MOTORBOAT: Any vessel propelled by machinery, whether or not such machinery is the principal source of propulsion.
OPERATE: To navigate or otherwise use a motorboat or a vessel.
OPERATOR: The person who operates, has actual physical control, or has charge of the navigation or use of a vessel.
PERMIT: Any written license or letter of consent issued by or under the authority of the city manager or a designee of the city manager, permitting the performance of a specific act or acts.
PERMITTEE: A person who lawfully possesses a permit.
PERSONAL FLOTATION DEVICE (PFD): A lifesaving device which has been approved by the U.S. coast guard.
PERSONAL WATERCRAFT: A vessel which uses an inboard motor powering a water jet pump as its primary source of motive power and which is designed to be operated by a person sitting, standing or kneeling on the vessel, rather than the conventional manner of sitting or standing inside the vessel, or a vessel which is similar in appearance and operation to a personal watercraft but which is powered by an outboard or propeller driven motor, or a vessel less than sixteen feet (16') in length which travels across the water above or on a cushion of air provided by engines, propellers or other means of propulsion.
PUBLIC WORKS DIRECTOR: That person designated by the city manager to be responsible for the supervision of building and maintenance operations at the lakes.
REPORTABLE BOATING ACCIDENT: An accident, collision or other casualty involving a vessel which results in loss of life, injury sufficient to require first aid or medical attention, or actual physical damage to property in excess of five hundred dollars ($500.00).
SCUBA: Divers equipped with self-contained underwater breathing apparatus.
TRAIL: Any designated path or trail for persons riding on horseback, walking or hiking.
UNDER WAY: The movement of a vessel whether by mechanical or nonmechanical means which is other than incidental to the force of wind, waves or current.
VESSEL: Every description of watercraft, other than a seaplane on the water, used or capable of being used as a means of transportation on water.
WAKE: The track of waves left by a vessel or other object moving through the water, and such waves are greater than the natural waves in the immediate area of the vessel, or are cresting and showing white water, or may cause injury or damage to any person or property.
WATERCRAFT: Any vessel used or capable of being used as a means of transportation on water, including, but not limited to, powerboats, cruisers, houseboats, sailboats, rowboats, canoes, kayaks, jet skis and any other such equipment. (Ord. 1994-06, 11-1-1994; amd. 2003 Code)
