§ 93.03 GAMES OR SPORTS.
   (A)   Except as explicitly permitted herein, it shall be unlawful for any person to play games, sports, or recreational activity on the streets or sidewalks of the town.
   (B)   It is unlawful for any person to place, or allow remaining in place, any basketball goals or other recreational equipment in public streets, highways, alleys, bridges, or squares.
   (C)   It is unlawful for any person to place, or to allow remaining in place, any basketball goals or other recreational equipment adjacent to the following public right-of-ways in the town when the utilization of the basketball goal or other recreational equipment allows the participants to actually encroach into the public right-of-way:
      (1)   Lincoln Avenue.
      (2)   The following streets north of Lincoln Avenue:
         (a)   State Street;
         (b)   Iowa Street;
         (c)   Jefferson Avenue;
         (d)   Fourth Street;
         (e)   Fifth Street;
         (f)   Heim Road;
         (g)   Inderrieden Road.
      (3)   The following streets south of Lincoln Avenue:
         (a)   Washington Avenue;
         (b)   State Street;
         (c)   Iowa Street;
         (d)   Greenwood Road;
         (e)   Fuquay Road;
         (f)   Gardner Road.
   (D)   If a basketball goal is permitted adjacent to a public right-of-way pursuant to this section, it shall comply with the following standards:
      (1)   At least 5 feet from manholes, catch basins, traffic signs, fire hydrants, and above ground electrical transformers, telephone boxes, and cable boxes. The pole for the basketball goal must be a minimum of 3 feet from street, trees, light poles, and mailboxes;
      (2)   A basketball goal backboard shall not extend beyond the face of the roadway curb;
      (3)   A basketball goal ring shall be at least 10 feet above the surface of the street, measured vertically from the public roadway; and
      (4)   There shall be at least a 100 feet unobstructed view as measured 10 feet out from the face of the curb and 5 feet high along the public roadway in both directions. There shall be no obstructions resulting from curves in such roadway, elevation changes, landscaping, or other fixtures located alongside such roadway, except if on a cul-de-sac, the hoop shall have an unobstructed view of at least 50 feet.
   (E)   Impoundment of property.
      (1)   Any basketball goal, other recreational equipment or other property blocking the right-of-way in violation of this section may be removed by the enforcing officer. The property shall be held until retrieved by the owner. The impounded property shall not be released from impoundment until:
         (a)   The actual charge for the impounding of the property to the place of impoundment is paid; and
         (b)    Storage charges in the amount of $5 per day, or part thereof, have been paid.
      (2)   The town shall not be responsible for any loss or damage sustained by any property so impounded or stored hereunder. Impounded property not reclaimed within 30 days from the date of impoundment shall be deemed abandoned and shall be sold as surplus property.
   (F)   All law enforcement officers of the town shall have the power and it shall be their duty to enforce the provisions of this section unless otherwise prevented by state statutes regarding the enforcement of state laws.
